Bad Advice: Bush's Lawyers in the War on Terror ReviewWe are now in an intense national debate about Bush administration policies that affect persons suspected of attacking America on and after 9/11. If you want to understand the role of indispensable players in the formulation of these policies -- the lawyers who advised President Bush, Vice President Cheney, and others in the Executive branch -- you will read "Bad Advice." The author, Harold Bruff, a leading expert on the separation of powers (see another of his books, "Balance of Forces"), tells the story with great care and without ideological bias; the book may be profitably read both by supporters and critics of the Bush administration. Mr. Bruff looks at dilemmas long faced by advisors who want to support their president, while at the same time giving him opinions consistent with the law. He analyzes how President Bush's lawyers fared in three cases: authorization of warrantless surveillance, detetion and trial of suspected enemies, and interrogation of detainees.
Although all lawyers will want this book on their shelves, it is by no means just for insiders. Bruff, ever attentive to the human element, gives insights into persons currently in the news -- Alberto Gonzales, John Yoo, Jay Bybee, David Addington to name a few -- and others from earlier times, including Sir Thomas More, Abraham Lincoln (his own best lawyer), and Robert Jackson, FDR's Attorney General, a Supreme Court Justice, and lead prosecutor at Nuremberg.

A March of Liberty: A Constitutional History of the United States Volume II: From 1877 to the Present ReviewAs far as history textbooks are concerned, I like this one. Yes, it's dense, but it's dense subject matter. The book is a lot less dry than it could be. Yes, the book is biased, but that can lead to interesting class discussion (or just plain thought), especially if one reads other essays/books on the subjects.
I'm trying to imagine a better constitutional history textbook and I can't, though I will not claim to be an expert on history textbooks. At least this one gives plenty of information to understand the history that surrounds the Supreme Court cases. The Age of Impeachment: American Constitutional Culture Since 1960 ReviewWhy have there been so many attempted impeachments of officials in the last fifty years? Have public officials become more corrupt than in the past? Has society and its standards changed? Has something else taken place? "The Age of Impeachment," by David E. Kyvig of Northern Illinois University, seeks to answer these and related questions in an interesting and insightful narrative.
Taking a chronological approach, Kyvig suggests that recent history, essentially the last fifty years, has been dominated by a rise in impeachment as a political tool for ridding the public sphere of rivals. After an introductory chapter that lays out the themes of the book, Kyvig explores three efforts to impeach Federal judges. He then follows with individual chapters on the efforts to impeach Vice President Spiro Agnew and President Richard Nixon. He also includes individual chapters on the push to impeach Presidents Ronald Reagan and Bill Clinton. Other case studies are also included, but in the end Kyvig suggests that the rise of an impeachment culture is detrimental to public life in the U.S. This may or may not be the case, but it is a conclusion that deserves serious reflection by all. Corwin, edited by Richard Loss, which I recommend. This is a summary of the opinions in landmark court cases, with an emphasis on those that Corwin disagreed with and considered unconstitutional. Nothing about this book is authored by Corwin, and, based on his actual writings, one must conclude that he would not have approved of his name being attached to it. This is a rather crude attempt to legitimize the many ways that the Constitution has been and is being violated. Read it, if you must, as revisionist doctrine and what statists would like to have you believe is established constitutional interpretation.Edward S.
